1. Acceptance
By using EternaPlay, you agree to these Terms of Service.
2. Service Description
EternaPlay is a browser-based digital MP3 player platform with free and premium features.
3. Accounts
- You must provide a valid email address
- You are responsible for keeping your account credentials secure
- You must not share login access in a way that violates these Terms
4. Account Data Usage
EternaPlay uses your email address and password only to create, authenticate, and manage your account. We do not request additional personal profile information as part of standard account access.
5. Subscriptions
- Paid features may be billed on a recurring basis
- Subscriptions automatically renew unless canceled
- Pricing is shown before purchase
6. Payments and Stripe Disclosure
Payments are processed by Stripe. By purchasing premium access, you also agree to any applicable Stripe terms and policies. EternaPlay does not store your full payment card information.
7. Cancellation and Refunds
- You may cancel at any time
- Access continues until the end of the current billing period unless otherwise stated
- Payments are non-refundable except where required by law
8. Acceptable Use
- No illegal use of the service
- No reverse engineering or attempts to interfere with the platform
- No unauthorized use of copyrighted material in violation of applicable law
9. Intellectual Property
EternaPlay owns the platform technology, interface, and branding, except for user-provided media.
10. Service Availability
We may update, modify, suspend, or discontinue parts of the service at any time.
11. Disclaimer
The service is provided "as is" without warranties of any kind, to the fullest extent allowed by law.
12. Limitation of Liability
We are not liable for damages, interruptions, or data loss arising from use of the service, except as required by law.
13. Termination
We may suspend or terminate accounts that violate these Terms or misuse the service.
14. Governing Law
These Terms are governed by the laws of North Carolina, United States.
15. Dispute Resolution and Arbitration
Agreement to Arbitrate: Most disputes will be resolved through binding arbitration rather than court.
Rules: Arbitration will be administered by the American Arbitration Association (AAA).
Waiver of Jury Trial: Both parties waive the right to a jury trial.
Class Action Waiver: Claims must be brought individually and not as part of a class action.
Location: North Carolina.
Exceptions: We may seek injunctive relief or use small claims court when permitted.
Opt-Out: You may opt out of arbitration within 30 days of first accepting these Terms by emailing giovanni@eternaplay.com.
Severability: If any portion of this section is found unenforceable, the remaining provisions remain in effect.
